Morning glories!
As I predicted in yesterday’s post, it’s that time again! Time for “Little Letters, 05.2018”. For a couple of months, I have happily had more gratitude than grumble. In last month’s post, here, and the post for March, here. But today’s notes are the opposite. More grumble than gratitude. Just been that kind of month. Have found that using these letters to vent is very therapeutic. So, that I will do. VENT, VENT, VENT! They can be equally wonderful for a quiet celebration. And there will be some of that, too. Glad you are here to join me. Shall we jump right in?
Little Letters, 05.2018
Grumbles
Dear Mark T. Davis,
It has been 6 months since we hired you to represent us in a law suit against the builder of our pool, Juan Carlos Rodriguez at Silver Springs Pool and Spa. We have had no update or information from you or your office except when I have called to check on the status of our suit. And then you and your secretary were less than forthcoming. We were finally granted an appointment with you last Friday only to learn that YOU:
- failed to read our pool contract, and failed to make a copy of the contract when we provided it to you.
- neglected to read ‘some clause’ in the contract that states that we cannot sue the pool company and yet you prepared and billed us for law suit paperwork that was served on Mr. Rodriguez in January.
- received an answer from Mr. Rodriguez’s attorney that you did not share with us.
- now state that we can not sue Silver Springs, would have to go through arbitration to try to resolve our issues with the pool, which would be cost-prohibitive to us.
- will not represent us any longer and will not refund our money.
In addition, when we sat down to meet with you, we were handed documents from Mr. Rodriguez’s lawyer to read that involved another client’s suit against Silver Springs. We believe that you did not even know who we were and so, inadvertently gave us the wrong paperwork to read as a result.

Dear City of El Paso, Office of Permits and Inspections,
On April 28, 2017, a Mr. Chris Wells came to our residence to conduct the final inspection on our pool. Mr. Wells walked into our backyard, walked across the yard to the gate on the side yard and back out to his vehicle. We passed with flying colors! Ha!
We have had a half-dozen issues with our pool to include cracking from the concrete up through to the deck surface, pergola beams cracked into two pieces, a missing gas trap for the gas line, chipped tiles, cracks in the pool plaster and electricity that does not meet code.
Several months ago, we began having issues with the electricity on our back porch and in our garage. When the electrician came out to check what was going on, he told us our pool had never passed its final inspection from the city.
Somehow, between April of last year and today, our pool went from passing its final inspection to failing. We cannot get a straight answer from anyone in the city’s office of permits and inspections.
The head of inspections for the city came out last Tuesday to check out electricity to the pool. He would not state whether there was faulty wiring but advised us that he would send us a letter stating all of the concerns he has with our pool. We will be able to use that letter to sue against Silver Springs’s bond. Supposedly.
Still waiting for that letter.

Gratitude
Dear Cleveland Clinic,
Thank you for getting my daughter Lauren in for an appointment so quickly. I am thankful that we have a diagnosis for her condition. We are anxious to get a treatment plan in place so she can begin feeling some relief to the pain she has felt for years. Looking forward to accompanying my daughter and my granddaughter on their trip to Cleveland in 10 days.

Dear PC,
Thank you for being such a good provider and responsible guy. You know how guilty I feel to not be working right now and contributing to our bills. Especially since our electricity needs to be repaired, our pool deck needs to be redone, our oven keeps shutting off, our faucets need to be replaced, our garage door just went out, and our AC had to be serviced. The strawberry cheesecake and jalapeño poppers I’ve made are a small token of my appreciation. I love you!

Dear Adrian,
The wood floors were poorly laid and did not withstand the moisture associated with our area and the 70’s slab. We paid $12,000+ 4 years ago and now we are paying $14,000+ and a lot of hassle to install wood tile. People depend on your expertise to correct misconceptions about apprpriate flooring for their home. We were not led away from be wood floors and should have been.

Dear Lance O’Dell,
Lumber Liquadators said you were the “Right Flooring” company. Your demolition was timely, your cement poorer professional, but your tiler is missing in action. Five days later, we haven’t made much progress. We want to be in our bedroom, cooking in our kitchen and walking upstairs without having to go outside and through the front door (at least it isn’t raining). Please Mauricio, tiler, come tomorrow as scheduled and hopefully your wife will be understanding.

Thank you for giving us two beautiful upstairs bathrooms. You are the best contractor we have dealt with. Although we hate being out of our bathroom during the current tiling with the current company, getting to enjoy our new upstairs bathrooms has been a joy.

Dear Leslie,
You certainly seem to be going through a run of bad luck at the moment and it sounds like if you could get your hands on that guy from Silver Springs you would have no hesitation on throwing him in the deep end (without asking first to see if he can swim). When you do finally get to sue him and get some of your money back and all the repairs made you will have to have a pool party to celebrate!

You are so right, thank goodness PC is home. If he had been gone much longer, he’d have found me banging my head against the wall. If the walls were still standing at that point.

Oh, Whitney, our pool issues just keep multiplying. But at least we had a swim on Saturday. Just scared I am going to wake up one morning to find the whole thing collapsed in on itself.

Oh gosh, it breaks my heart to hear how many issues you continue to have with your pool and trying to resolve the issues! I know you just wanted a retreat and it was a big treat for yourselves when you decided to get it. I hope and pray it all gets resolved soon!

Holy Cow! That pool sounds like a nightmare – and how on earth can you have a clause that says you can’t be sued for doing sub-standard (dangerous) work? Can you sue him if your house slides into the pool or if one of you gets gassed or electrocuted?? And your lawyer sounds like a skunk! Good on you for standing your ground and I really do hope things work out for you Leslie xx
